The court set aside the judgement of the trial court which declared the immediate past Minister of State for Mines and Steel Development, Dr. Uche Ogah as the party’s governorship candidate in Abia.
Counsel to Dr. Uche Ogah, Barr. Chijioke Udeogu in a swift reaction however rejected the judgement of the Appeal Court, saying the court shifted the duty of discharging the burden of proof to his client (1st Defendant) instead of the appellants (Emenike and APC).
He said the appellants who are pressing allegations against his client, saying they have the burden of proof.
Barr. Chijioke said he will file a notice of appeal to the Supreme Court to challenge the decision of the Appeal Court, saying it will not stand legal scrutiny.
