Judge Rules That A Landlord’s Outstanding Electricity Bill Or That Of Previous Tenant Can’t Be Enforced On A New Tenant

Nigeria Electricity Regulatory Commission has announced that a landlord’s outstanding electricity bill or that of the previous tenant can’t be enforced on a new tenant, according to a judge ruling.

NERC wrote on Twitter: “A Landlord’s outstanding electricity bills cannot be enforced on a tenant.

“A judge recently ruled that the bills of a previous tenant cannot be enforced on a new customer.

“Send us details if you are in such situations. ~Commissioner Nathan Shatti.”

Nigerians reacted to this revelation asking if the judge’s ruling will be applied.

One Twitter user wrote: “Why is @NERCNG saying one thing and DICSO @AEDCELECTRICITY doing another? Are we not being scammed?”

And Abuja Electricity Distribution gave a contradictory reply via its official Twitter account @AEDCELECTRICITY, writing: “Hello, please be informed that once a property has accrued debts on the account. It continues to reflect until it is cleared. However, the tenants is supposed to have a discussion with the Landlord on how to clear off their outstanding debt.”

A Twitter user responded to Abuja Electricity Distribution, writing: “Do you even know what you are saying? There was a ruling and you are saying your own. Are you the judge?”

Buhari Inherited Terribly Divided Country From Jonathan – Femi Adesina Tells Soyinka

Femi Adesina, Special Adviser on Media and Publicity to President Muhammadu Buhari, has said that the President inherited a terribly divided country from his predecessor, Goodluck Jonathan, in 2015.

Speaking during a Channels TV programme on Wednesday, Adesina described Nigeria as an inconvenient amalgamation, which has always been divided.

He was reacting to comments made by Wole Soyinka, playwright and Nobel laureate, who said that Nigeria was more divided than ever before.

The President’s spokesperson said in a country of 200 million people, it would be impossible for everyone to agree and perceive things the same way.

He said, “Nigeria had always been divided right from amalgamation in 1914. Nigeria is an inconvenient amalgamation but we have kept at it and we have worked at it.

“And I tell you that there is no time in the history of this country that the country was not divided. But then, we have kept at it and we are trying to make it work.

“As at 2015 when President Buhari came, Nigeria was terribly divided; divided along ethnic, religious and political lines; divided along language; divided hopelessly and terribly.”

The President’s aide said in 2015, Soyinka did not support Buhari but only tagged him as slightly better than Jonathan.

FG Approves Creation Of New Anti-Corruption Agency

The federal government on Wednesday approved the establishment of “ The Proceeds of Crime Recovery and Management Agency, to join the growing list of anti graft agencies established by the government

The government had in efforts to tackle corruption, established the Economic and Financial Crime Commission EFCC Act of 2004, the Independent Corrupt Practices & Other Related Offences Act 2000, the Advance Fee Fraud and Other Related Offences Act 2006 and the Money Laundering (Prohibition) (Amendment) Act 2012.

Others include the Miscellaneous Offences Act, Code of Conduct Act, the Nigerian Extractive Industries Transparency Initiative Act, the Freedom of Information Act 2011, the Fiscal Responsibilities Act 2010, as well as the Penal Code Laws of Federation of Nigeria 2004.

The government also promulgated the Criminal Code Law of Federation of Nigeria 2004, the Banks and Other Financial Institutions (Amendment) Act 1991 and the Failed Banks (Recovery of Debts) and Financial Malpractices in Banks (Amendment) Act 1994.

At the virtual meeting of the Federal Executive Council FEC presided over by President Muhammadu Buhari at the presidential villa, Abuja, the Council approved the transmission of a bill named “Proceeds of Crime Recovery and Management Agency Bill,” to the National Assembly.

Minister of Justice and Attorney General of the Federation, Abubakar Malami, explained that the agency is necessary to mange assets that constitute proceeds of crimes as he pointed out that previous proceeds of crime are scattered in different and multiple agencies.

“The Federal Ministry of Justice presented to Council a memo today. The Council memo is about a Bill which will seeks the approval of the Council to transmit to the National Assembly for passage. It is Proceeds of Crime Recovery and management Agency Bill.

“It is in essence a bill that is targeted and intended to have in place a legal and institutional framework. The legal component of it is having a law. And the institutional component of it is to have an agency that will be saddled with the responsibility of managing the assets that constitute the proceeds of crime in Nigeria.

“What happens before now is the proceeds of crime are scattered all over, and mostly in the hands of different and multiple agencies of government inclusive of the police, the DSS, EFCC, and ICPC.

“So, with that kind of arrangement which is ad-hoc, there is no agency of government that is saddled with the responsibility of data generation, an agency that can give you off-head the number of landed assets, number of immovable assets, the amount in cash that are recovered by the federal government by way of interim forfeiture overweigh of a
final forfeigture.

“So, it is indeed overtime a kind of arrangement that is not uniform and consistent.”

According to him, the new law seeks to move the fight against corruption to the next level.

He added: “Next level of transparency, next level of accountability in essence, will have in place an agency of government that is exclusively responsible for anything proceeds of crime.

“A one-stop shop arrangement by which all the assests that are recovered arising from crimes that are indeed vested in the federal government, you have a one-stop arrangenet where you can have an information. As it is for example, the Federal Ministry of Justice is only in a position to account and giving comprehensive account of what
recoveries were made by the ministry.

“But any recovery made by the police, DSS, the Ministry of Justice is not in a position to know. So, for the purpose of decision making and policy, the federal government is not in a position to have a wholistic appreciation.

“So, by the bill that is now presented for the consideration of the council, we’ll have a law that establishes an agency, and secondly, an agency.

“And as you rightly know, Mr President has sanctioned ever since he came on board, that there should be a budget line, a budget item for recovered assets.

“So, if you have a budget item for recovered assets, this agency will now be in a position to provide information to the Federal Ministry of Finance, Budget and National Planning on demand as to what amount is available for budget purposes, thereby establishing the desired transparency, the desired accountability which has not been available before now.

“So, it is about a memo that seeks to establish a legal framework, that seeks to establish institutional framework, that seeks to further take the fight against corruption to the next level by way of establishing transparency, accountability and making the possibility of forfeiture a proceeds of crime easy through the sanctioning of non-conviction based forfeiture among others.”

When asked whether the bill stemmed from his experience with the suspended Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu, he said it had been long in planning.

Malami further explained: “Let me take you through the history lane as far as the proceeds of crime bill is concerned. There was an attempt some time back in 2007 to present to the FEC, it was unsuccessful, the bill was not passed.

“There was further attempt in 2011 to present same bill with some material amendments, and then it did not succeed in getting the blessings of FEC. And there was a further attempt in 2019 to present the Bill and it wasn’t as well successful but it eventually
succeeded today.

“So, perhaps to now tie it to a particular institution or particular development of 2020, I think is unfounded taking into consideration the historical antecedents relating to the bill.“

On the controversy surrounding the new gazette he issued, which has been seen as an attempt to weaken the Nigerian Bar Association (NBA), he said: “The first question has to do with rules of professional conduct with particular reference to a gazet in contention. My response is simple, that the matter is being interrogated and id make statement at the
appropriate time and id say no more as far as that issue is concerned.”

FEC also approved a new national policy on occupational safety and health, tagged: “National Policy on Occupational Safety 2020.”

Minister of Labour and employment, Chris Ngige disclosed this while briefing correspondents on his memo to FEC.

He explained that the new policy is aimed at ensuring that all workers are safe at their work places across the country, adding that it derives from provisions of the Nigerian constitution and the International Labour Organisation’s (ILO) convention.

Ngige added: “The Federal executive Council today approved a new policy on occupational safety and health-2020. This policy is designed to make for safety and health of workers at work places.

“It derives from the main ground norm norm law of the 1999 constitution as amended, which in section 17 (3c) prescribes that the Nigerian State shall make laws and bye-laws for preservation of the health and well-being of workers in the work places; men and women at work.

“It also derives form the ILO convention 155, which Nigeria has also domesticated. Again, that talks about making the work place conducive and ensuring the health and well-being of workers.”

The Minister said the last time the policy was reviewed was 14 years ago but the new one has a review period of three years.

He stated: “The last policy we have was approved in 2006 which makes it exactly 14 years since that was approved by the Federal Executive Council and that is the policy we have been working on. But you know that 14 years is a long span in the life of any law so in the course of operation, certain issues have been thrown up, the world has gone digital, work place mechanism and hazards have been changing and it was therefore necessary that we do a new policy.

“This policy we did now is what you call repeal and replace and it takes care of all that is needed for now, for the health of Nigerian workers.”

Continuing, he said: “It gives specific roles to agencies, National Environmental Standards and Regulations Enforcement Agency (NESREA,) Nigerian Civil Aviation Authority (NCAA,) Nigerian Maritime Administration and Safety Agency (NIMASA), Standards Organisation of Nigeria and the Federal Ministry of Health.

“Everybody has his own role now because it’s a cross-cutting situation as most Ministries, Departments and Agencies of government are involved.”

On the seven-day ultimatum given by the Trade Union Congress (TUC) threatening strike action, the Minister maintained that it is misplaced because it was addressed to the President of Nigerian, which he said, contravenes labour laws.

He said: “The TUC issue, the seven-day ultimatum was misplaced because they were writing the President and issuing an ultimatum to him.

“The President is not recognised by ILO. The competent authority for this nature of the dispute in Nigeria resides in the man who oversees them, which is whoever is the Minister of Labour and Employment.”

Buhari Prevented Nigeria From Becoming Failed State – Lai Mohammed

The Minister of Information and Culture, Lai Mohammed, has said that President Muhammadu Buhari’s assumption of office in 2015 prevented Nigeria from becoming a failed state.

Mohammed said Buhari saved Nigeria after what he called a “long stretch of rapacious and rudderless leadership.”

The minister stated this in a statement signed and forwarded to DAILY POST by his Media Aide, Segun Adeyemi.

He stated that Buhari assumed power at a time when the country was besieged by insurgents, stressing that many Nigerian towns and cities, including the capital city of Abuja, were a playground for insurgents.

Mohammed also pointed out that prior to Buhari’s assumption of power, Nigeria’s wealth had been looted dry, with little or nothing to show for the nation’s huge earnings.

He said: ”Nigeria today faces a lot of challenges. But whatever situation the country has found itself in, things would have been much worse but for the deft management of resources, unprecedented fight against corruption, determined battle against insurgency and banditry as well as the abiding courage of Mr President in piloting the ship of state.

”Nigeria today is not a failed state, but a nation that is courageously tackling its challenges and building solid infrastructure that will serve as the basis for socio-economic development, a nation that is unrelenting in battling insecurity and working hard to ensure greatest prosperity for the greatest number of people.”

MY TAKE ON THE RECENT OUTBURST TOWARDS SOME OF OUR PARTY LEADERS WITHIN ABIA STATE CHAPTER OF THE PARTY.

I’m constrained by my conscience to use this medium to share my thoughts as they specifically relate to the recent turn of events regarding the outburst of some of the leaders of our great party APC within Abia state Chapter of the party and its attendant consequences.

For a couple of weeks now some of our party leaders in the state have engaged themselves in some sort of war of words which has, invariably, thrown very many of the party members in the state into confusion and this does not augur well for the future the party.

Leadership, no doubt, is an uphill task as it comes with a whole lot of responsibilities, including, the ability to have the fortitude to bear pains and continue to give a reassuring smile in order to kindle the hope of followers.
As a matter of fact, for any person who is occupying a position of leadership to excel and impact others positively, such a person must be tolerant and ready to accommodate all shades of opinion as this will enable him or her build a team of devout and devoted followers.

As a rallying point, a leader should always strive to unite both the centrifugal and the centripetal forces in his or her fold which presupposes that he or she must treat everyone fairly and eschew all actions or inactions that may tend to divide members of his fold.
Leaders are expected to be transparently honest and sincere to the people they are leading. A leader must lead by example because example, they say, is better than precept. Bearing this in mind, it would, therefore, be unbecoming for a leader to indulge in any act that is capable of destroying a house he or she laboured to build.

Again, it is not in doubt that one of the hallmarks of a leader is the ability to control his or her anger and utterances as he or she is not expected to allow his or her sentimental emotions to overrule his or her sagacity.
Following from the above, I must confess that it has apparently become imperative for me to appeal to some of the leaders of our great party within Abia state chapter of the party to refrain from the ongoing war of words or bandying of words among themselves.
Recently, the social media has been inundated with pejorative and opprobrious write ups against some leaders of the party from the State and these despicable acts are the handiworks of some of the aids and or handlers of these leaders yet nobody has bothered to call these aids and handlers to order.

It is obvious that the more we allow these to continue the more devastating effects it will have on the unity and cohesion of the party within the state and it needs not be emphasized that unity and cohesion are what our party in the state needs at the moment to be able to face 2023 elections successfully; hence, we must jettison every form of internal wrangling or in fighting in the party within the state chapter.
It is on this score that I want to, once more, appeal to all and sundry to sheath their sword and embrace peace, unity and love for one another in the party.
Of a truth, what we need now in our party is concerted efforts to swell the membership of this party while building on the achievements already recorded as part of our strategy geared towards taking over power in the state come 2023, hence, I’m passionately appealing to all the leaders and party faithful to cooperate and collaborate with one another so as to enable us coordinate our activities and channel same towards achieving our common purpose of taking over power in the state come 2023 instead of dissipating energy towards unnecessary internal wrangling.
In other words, we must shun all forms of unhealthy rivalry or internal wrangling in the party at this point in time as that will only do us more harm than good.

There is no gain saying the fact that every member of our great party joined the party for one reason or another but that does not detract from the fact that every member of the party is expected to work towards the realization of the common objective of the party and we cannot do that unless we are ready to subsume our individual interests into the overall interest of the party.
It is my belief that the overall interest of our party in the state is to win all the future elections in the state and that being the case, we must start now to value and accord deserving respect to every member of the party no matter how highly or lowly placed because politics is a game of number and human beings are the only raw materials for winning elections.

Finally, I must commend some party leaders and stalwarts in the state such as Sir Mac Wabara and Hon. Ben Kalu for their individual roles and efforts towards ensuring that there is peace, decorum and cohesion in our party in Abia State and I sincerely urge all to consider their observations and let us work together for the growth and success of our party in the state. In conclusion, I pray for the peace, cohesion and unity of purpose of our great party, APC in Abia State.

Don’t Come To Edo With Bullion Vans” – Tambuwal Mocks Tinubu

The Peoples Democratic Party (PDP) National Campaign Council Chairman, Nyesom Wike has declared that Governor Godwin Obaseki would win the Edo governorship election convincingly.

Wike, who is also the Governor of Rivers State, made the assertion at the Grand Finale of the Edo PDP Campaign held at the Samuel Ogbemudia Stadium in Benin City.

Wike said the convincing evidence on ground has shown the general acceptance of the party by the electorate.

He stated that with the achievements of the last four years, it would be impossible for Obaseki not to be declared the winner.

The Rivers governor, however, urged Edo people not to take things for granted but turn out in large numbers to vote the candidate of PDP.

“By the grace of God, the election has been won by Governor Obaseki. That does not mean that you’ll go and sleep. Everybody that wants to fight godfatherism should come out to vote.

“Use Edo election to end godfatherism. Make sure you vote and be vigilant too.

“I agree with the Independent National Electoral Commission (INEC) that the election will be free and fair. Even the Inspector General of Police has promised that nobody will rig the election. But do not leave the polling units after casting your votes.

“Repeat the Rivers State Model. Let every woman wear jean on election day, cast and defend your votes.

“Follow the votes to the Collation Centres. Do not go until INEC has announced Godwin Obaseki as the winner,” he said.

National Chairman of the Peoples Democratic Party (PDP), Prince Uche Secondus described the Edo election as a special one.

He said the election would determine the status of elective democracy in Nigeria that is devoid of rigging.

“Let there be more restrictions for election riggers. Just like the United States has done, I call on other democratic countries of the world to rise to protect Nigeria’s democracy.

“We all know that Obaseki is a performing governor. He has impacted the lives of Edo people. Let their will prevail. Edo people should resist all forms of godfatherism,” he stated.

In his speech, the Chairman of PDP Governors’ Forum, and Governor of Sokoto State, Alhaji Aminu Waziri Tambuwal urged Edo people not to sell their votes.

“I hear somebody said he will come to Edo with bullion vans. Stand firm and do not sell your votes.

“I appeal to INEC to conduct free and fair election. There should not be intimidation of the electorate.

“Stay at your polling units. Ensure your votes are counted. Vote for continuity,” he stated.

On his part, the Chairman of South-South Governors’ Forum and Governor of Delta State, Governor Ifeanyi Okowa said nobody can cheat PDP of its votes because it is a majority party in Edo State.

“We are not afraid. Nobody will change the results or cheat us on Saturday.

“You have done extensive campaign, from ward to ward. Pick your PVC on Saturday, go to your polling units and cast your votes for PDP,” he said.

Former Vice Presidential Candidate of the PDP, Peter Obi also spoke and urged Edo electorate not to vote the APC candidate for the sake of Nigeria.

According to him, we want Nigeria to be good and people like Obaseki are trusted.

The mega rally was also attended by the Governor of Bayelsa State, Douye Diri, and his Akwa-Ibom State counterpart, Emmanuel Udom.

Also in attendance were the Adamawa State Governor, Ahmadu Umaru Fintiri, his Abia State counterpart, Okezie Ikpeazu, the Oyo State Governor, Seyi Makinde, and the Cross River State Governor, Professor Benedict Ayade.

Other dignitaries that accompanied the Rivers State Governor were the former Governor of Rivers State, Sir Celestine Omehia, former Deputy Speaker of the House of Representatives, Rt. Hon. Austin Opara and former Minister of Transport, Chief Abiye Sekibo.

Nigeria Most Prosperous Black Nation, Says Buhari

President Muhammadu Buhari has described Nigeria as Africa’s largest economy, most prosperous black nation in the world.

The President said this on Wednesday while unveiling the theme and logo for the commemorative activities to celebrate 60 years of the country’s independence.

In a statement signed by the Special Adviser on Media and Publicity to the President, Femi Adesina, the theme of Nigeria at 60, TOGETHER, with the logo was projected and unveiled virtually on the 12 by 20 feet screen at the Council Chambers, before the commencement of the e-Federal Executive Council (FEC) meeting presided over by President Buhari.

The President performed the exercise in the presence of some cabinet ministers and other members of the council who joined the meeting online.

”Today, we stand on the threshold of history as we formally begin a series of activities commemorating Nigeria’s Diamond Anniversary.

”The task history has saddled me with today is to proclaim a theme that will keep us united, help us forge ahead and unveil a logo that will form the critical pillars which our 11-month modest commemorative activities would rest on.

”Celebrating sixty years of independence really calls for pomp, but the global COVID-19 pandemic, which has forced all nations in the world to think and act differently, has also foisted on us the imperative of a low-keyed celebration.

”Operating within the limitations placed by the COVID-19 pandemic, we created an internet challenge for Nigerians to make a choice from a set of four pre-selected logos that would appropriately define the theme.

”Of these four options, Nigerians from all walks of life participated in making a choice and I am happy to let you know that the logo I would be unveiling is a product of choice from the Nigerian people,” President Buhari said.

Speaking further on the logo, the President declared:

”Furthermore, the neatly encrusted Diamond on the Nigerian Map symbolizes our age of treasure, the worth of the Nigerian people with our sparkle to the admiration of the world.

‘‘In the same vein, the pear green and dark green colours should respectively remind us of our warmth, welcoming spirit and love as well as the abundant wealth inherent in our human capital and the richness of our land.

‘‘All these properties make us unarguably the most prosperous black nation in the world and Africa’s largest economy.’’

On the theme of TOGETHER, President Buhari recounted that the country’s founding fathers, in spite of the differences in faith, tribe and tongue came together to fight for Nigeria’s independence.

‘‘This shall be a befitting tribute to the struggles of our heroes past,’’ he said.

The President thanked members of the Inter-Ministerial Committee (IMC) on Nigeria’s Sixtieth Anniversary Celebration for the work they have done so far, reminding them ‘‘that this is just the beginning.’’

President Buhari pledged that his government would work towards greater inclusiveness and look forward to the participation of all Nigerians in the celebration.

Abia Govt Vows To Prosecute Those Responsible For Collapsed Building In Aba

Abia State Governor, Dr Okezie Ikpeazu, has directed Abia State Environmental Protection Agency (ASEPA) and the Aba South LGA Town Planning Authority to immediately ensure full and safe demolition of the partially collapsed 3-storey building along Azikiwe Road in Aba.

This was disclosed by the state Commissioner for Information, Chief John Okiyi Kalu, during a radio program monitored by ABN TV in Umuahia this morning.

According to him, “The Government received with sadness news of the collapse of the 3-storey building which was under construction in the early hours of today and the Governor immediately directed relevant agencies to the location as well as mobilized earth moving equipment to the site on a search and rescue mission. So far, we have one confirmed fatality and those on site are working to see if there are others trapped in the rubble”.

On the possible cause of the collapse, he stated that investigations are ongoing by government and security agents including men of the state police command, fire service and town planning authorities already at the site. He observed that preliminary information indicates that the plan for the building is yet to be approved with on-site evaluations indicating that the materials used to construct the collapsed part of the structure being sub-standard.

Chief Okiyi stated further that security agents are currently on the hunt for the building engineer and developer of the property.

He also informed that most of the building was hurriedly put up during the COVID-19 lockdown period with a view to possibly evade the town planning authorities.

The Commissioner warned that government will not tolerate a repeat of the situation where buildings are indiscriminately erected without proper approval and supervision and assured that government will get to the root of the matter and ensure that all those found culpable in this particular instance are prosecuted.

THE Miyetti Allah Cattle Breeders’ Association of Nigeria, MACBAN, South-East zone, has explained that its interest in the zone is purely economic not domination.

MACBAN in the zone, Alhaji Gidado Siddiki, who gave the explanation Monday after a meeting of the joint executive council of the group in Enugu, said that the explanation became necessary following growing suspicion and speculation in some quarters.

Sidiki said that the thinking that their interest in the zone were beyond economic pursuits was wrong, insisting that they are in the South East only to do their business of cow selling.

According to him, the suspicion that the herdsmen were aiding and abetting Fulani territorial expansionism was not true, saying such suspicion has created unhealthy relationships in most parts of the South East region, which he said has made their members uncomfortable.

The MACBAN leader explained that the herders in the region were interested and desirous of striking a harmonious relationship with the people of the area to avoid mutual suspicion.

“This suspicion is rooted upon the speculations that herdsmen are harbingers of Fulani territorial expansionism. However, the leadership of MACBAN under my watch in the South East has continued to dialogue appreciably well with the individual state governments in the zone.

“I am happy that the dialogue gives us hope for better understanding between our members and their host communities,”

Siddiki said, pointing out that the group would not hesitate to report any of its members found to be involved in criminal activities to law enforcement agencies.

He urged the governments of South-East states to ensure the protection of their members and cattle, saying that herdsmen in the area would be made to take precaution in the course of doing their business.

“We, hereby, jointly resolve to fully lend our efforts toward fostering an enduring and harmonious relationship with our host communities. We urge members of our host communities to be more accommodating too”, he said.

According to Siddiki, the South East people are good people and that MACBAN would not do anything to create tension in the area.

“You Don’t Have The Right To Protest Against High Electricity Tarriff” – Police Tell Youths (Video)

Some Nigerian youths who took to the streets of Abuja to protest against the increased electricity tariff, were spotted in a viral video being assaulted by some policemen.

One of the protesters, @AyowoleSanyaolu who noted that the protest at the Nigerian Electricity Regulatory Commission (NERC) office in Abuja was a peaceful one, said they were stopped by the policemen who assaulted them, telling them that they don’t have the right to protest.

He tweeted:

“While we protest peacefully at @NERCNG , Abuja, against the thoughtless increment in electricity tariff, @PoliceNG descended on us fiercely. A number of us were mercilessly beaten and others were dragged like common criminals. But in all, we stood our ground. Tyranny will not win!”
