Doctors Must Treat Gunshot, Stab Victims Without Report — Police

The Nigeria Police Force (NPF) has restated that doctors and hospital personnel are mandated to treat gunshot and stab victims without requesting for any police report.

The Police said every medical facility in the country was free to receive and treat victims of gunshot wounds with or without Police clearance, but are duty-bound to report to the nearest Police station after commencing treatment of the victim.

Recently, a young lady allegedly died in Lagos from her wound after being stabbed by armed robbers because a medical facility refused to attend to her without a Police report, although the hospital later denied refusing to treat her for any such reason.

Speaking in an interview, Force Public Relations Officer (FPRO), Mr. Frank Mba, a Deputy Commissioner of Police (DCP), assured that the Police would not in any way operationally or administratively come in-between medical practitioners and the discharge of their fundamental responsibility, The Guardian reports.

He said, “By the laws of our land, victims of gunshot wounds, victims of road accidents, victims of life stabs or any other type of stabbing do not require a Police report before being treated by medical personnel. That position is very clear.

“The only requirement of the law as regards the treatments of gunshot wounds is that medical doctors, paramedics or other health workers are required to inform the Police after treatments have commenced. In other words, this requirement does not in any way preclude or bar them from initiating medical treatments.

“Remember that fundamentally, the core duty of doctors and other professionals in the health sector is to save life.”

According to Mba, “It is sheer mischief, ignorance, disinformation or misinformation for anyone to say that you must get a Police report before you are treated as a victim of a gunshot wound. The requirement is after the doctors must have saved life and stabilised the victim, they are required to report after treatment and not before treatment.

“That requirement is intended to avoid a scenario where a suspected armed robber, cultist, kidnapper or even a terrorist, after sustaining a gunshot wound during an engagement with the Police or other law enforcement officers, gets treated and probably continues in his criminal activities.”

The Economic and Financial Crimes Commission, EFCC, on Saturday, December 14, 2019, moved to the next level in fulfilling the terms of the court sentence passed on former Abia State governor, Senator Orji Uzor Kalu.

The anti-graft agency said it has begun marking properties belonging to him to seek reparation for the N7.65b stolen from the Abia state treasury..

The marking is to ensure that the properties are not dissipated, following the December 5, 2019 order of Justice Muhammed Idris sitting at the Federal High Court in Ikoyi, Lagos that Kalu’s company, Slok Nigeria Limited, be wound up and all assets forfeited to the Federal Government.

Kalu, who is the Senator representing Abia North in the National Assembly, had been arraigned alongside his company, Slok Nigeria Limited, and Udeh Udeogu, his Director of Finance and Accounts at the Abia State Government House, over an amended 39-count charge bordering on conspiring and diverting the sum of N7.65bn from the coffers of the state.

The defendants pleaded not guilty to the charge preferred against them by the EFCC, thereby leading to their full trial.

In the course of the trial, the prosecution counsel, Rotimi Jacobs, SAN, called 19 witnesses and tendered several documents that were admitted in evidence by the court.

The defendants, however, testified on their behalf of themselves during the trial.

The parties, during the proceedings on Tuesday, October 22, 2019, adopted their final written addresses.

In his final submission, the prosecution counsel, Jacobs, urged the judge to jail the defendants, saying the prosecution had proved the allegations against them.

Jacobs also urged the court to wind up the company as provided by the Law and all its assets forfeited to the Federal Government.

However, the defence counsel urged the court to “dismiss the charges, acquit and discharge” their clients.

Delivering his judgment, Justice Idris found the defendants guilty on all counts.

Justice Idris held that the prosecution had established its case against the defendants.

The Judge further held that “the case was conclusively investigated, as the prosecution conducted thorough investigations.”

Justice Idris, therefore, convicted and sentenced the first defendant,
Kalu to five years imprisonment on counts 1, 2, 3, 4, 6, 7, 8, 9, 10 and 11; three years on counts 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33; 12 years on counts 34, 35, 36, 37 and 38 and five years on count 39.

The second defendant was convicted and sentenced to three years imprisonment on counts 24, 25, 27, 28, 30, 31, 32 and 10 years on counts 34, 37, 38 and 39.

Justice Idris further held that “In respect of the third convict, Slok Nigeria Limited, an order is hereby made that the company shall hereupon and without further assurances, but for this order, be wound up and all its assets and properties forfeited to the Federal Government of Nigeria.”

We Are Not Secret Society, Ogboni Fraternity Opens Up On Activities

Leader of the Reformed Ogboni Fraternity (ROF), Chief Francis Meshioye, has again debunked public perception that the fraternity was a secret society.

Addressing newsmen in Lagos during flag off of 2019 Founders’ Day Celebration of ROF, Meshioye, said there was nothing sinister in the activities of the fraternity.

We are far from being a secret society; we are a registered entity that abides with the laws of the land and our objectives are to promote positive values, truth, justice and cultural heritage,” he said.

He explained that contrary to beliefs in some quarters, there was nothing secret or sinister about the fraternity, saying it was founded for the good of the society.

Meshionye further explained that the fraternity was actually founded in 1914 by a Christian, Deacon Jacobson Ogunbiyi, saying the initial objective was to promote Christian values among the people.

He added that the group was later expanded to accommodate people of other faiths, hence the change in name from Ogboni Fraternity to Reformed Ogboni Fraternity.

Meshioye said a number of distinguished Nigerians, dead and living, were members of the group, emphasising that the fraternity was strictly for positive values.

He said that it was note-worthy that the founding fathers of ROF were part of those who fought for decolonisation of Nigeria, developed such establishments as the civil service, judiciary and many functional post-colonial institutions.

He listed some of them as late Sir Adetokunbo Ademola, late Chief Ladoke Akintola and late Sir Adeyemo Alakija.

The ROF leader said every Nigerian of good character could join the group as the fraternity was not for those who were seeking quick wealth.

According to Meshioye, it is important for people to understand what the group stands for, urging Nigerians to embrace the virtues of the fraternity

“The Reformed Ogboni Fraternity (ROF) has the ultimate objective of promoting good values, love discipline, not only in Nigeria but in other parts of the world wherever her members finds him or herself.

“There is a clear distinction between ROF as a fraternity and any other forms of organisations.

“Our fraternity compels her members to imbibe the fundamental injunction of ”do unto others as you wish others to do unto you.

“However, the fraternity had to overcome many challenges that were rooted in misinterpretations of what we stand for,” Meshioye said.

He said the celebration of ROF’s 2019 Founders’ Day was to promote the ideals of the fraternity and show the world that the group was all positive.

Man Slumps, Dies At Murtala Muhammed Int’l Airport Lagos

A passenger identified as Chukwuma Anthony Ezeh, on Wednesday slumped and died at the Murtala Muhammed International Airport (MMIA), Lagos.

ABN TV gathered that the passenger slumped on arrival from China and died while waiting to collect his luggage

According to information on his passport, Ezeh was 47 years old at the time of the incident.

Spokesperson of the Police MMIA Command, DSP Joseph Alabi, who confirmed the incident to our correspondent at about 9.25p.m. on Wednesday, said the passenger came on board Ethiopian Airline.

According to him, the incident happened at about 3:15p.m. and the deceased was confirmed dead at the MMIA Clinic.

“While walking at the arrival hall the man slumped and died,” he said.

Alabi added that Ezeh’s corpse had been deposited at the Air Force Base Hospital mortuary.

Buhari Presents FCT Budget To Senate

President Muhammadu Buhari on Wednesday forwarded the 2020 budget of the Federal Capital Territory Administration (FCTA) to the Senate for consideration and approval.

The Senate President, Ahmad Lawan read Buhari’s request letter at plenary.

Buhari in his letter noted that the request was in compliance with Sections 121 and 299 of the 1999 Constitution (as amended).

The letter reads in part: “Pursuant to Sections 121 and 299 of the 1999 Constitution of the Federal Republic of Nigeria (as amended), I forward herewith, the 2020 statutory budget proposal of the Federal Capital Territory Administration, for the kind consideration and passage by the Senate.

Also on Wednesday, the upper chamber approved the report of the Conference Committee of the Senate and House of Representatives on the Finance Bill 2019, recently passed by both chambers.

Reps Summon Power, Labour Ministers Over Planned Strike By Electricity Workers

The House of Representatives has summoned the Minister of Labour and Employment and the Minister of Power as well as the Director-General of the National Pension Commission to appear before it on Thursday, December 12, 2019 to brief the leadership on the planned strike by electricity workers in the country.

The House expressed displeasure that the 21-day ultimatum issued by the National Union of Electricity Employees (NUEE) was allowed to elapse without any effort to nip the planned strike in the bud.

The summon arose as a result of a motion of urgent public importance sponsored by Hon. Toby Okechukwu (PDP, Enugu) on the need for the House to intervene and ensure that the strike is not allowed to take place.

Okechukwu said that if the strike is allowed to take place, it is capable of creating untold economic hardship in the country as several business outfits, especially the small scale businesses will suffer.

He said it was not in the interest of the nation to allow the strike to go ahead, adding that as representatives of the people, the lawmakers must find solution by inviting the relevant stakeholders to dialogue with a view to finding lasting solution to the problem.

Stand up for your right now, Barr. Ubani charges youths

A human right lawyer and former vice chairman NBA, Ikeja branch, Barr. Monday Ubani has challenged Nigerian youths to stand up from their comfort zones and demand for their rights, insisting that the youths under this dispensation are endangered species.

He made this call on Tuesday while delivering a lecture in Lagos during the NBA annual human right lecture.

While maintaining that the youths have not been visible in the political environment, he observed that in the past, youths were instrumental in fighting for the country’s Independence.

He expressed regret that the current regime has not done enough in strengthening human rights, but has fought to clampdown on dissenting voices.

He called on youths to start making efforts to take up leadership positions to rewrite the country’s history.

My commendation goes to the Key Note Speaker Prof Chidi ODINKALU. Having read his paper sent to me two days ago, I adopt same as mine but I have few words which I have put down in writing to add to the discourse.

The truth of the matter is that Nigerian youth have sat down for too long and need to get up, stand up for their rights. The Nigerian youths under the new dispensation are endangered specie, they are buffeted right, left and centre. It is either they are arrested and flung into long detention by both States and Federal government authorities or that the government of the day are enacting laws through the legislative assemblies to permanently shut their mouth up in the name of regulating the social media space. If you are in doubt about how serious the onslaught has become, the event of last Friday where a youth in the name of Yele Sowore was wrestled to the ground in the court room in the full glare of the world as shown in the social media should get you convinced that a full blown war has been declared against the youth of this country.

Every new government in Nigeria comes with mouth watering promises which hardly get fulfilled. The new government in place came with the kind of promises that even the devil would have been convinced except some few angels who kept warning that the leopard cannot change its skin. Having been elected and they fell short of expectations including the display of executive recklessness, criticisms came in torrents. Comrade Yele Sowore called for a revolution which the government of the day equated to plan to overthrow the elected government of President Buhari. He has been arrested since August this year and kept in perpetual detention while they have flagrantly disobeyed the orders of the court to have him out on bail. He was re-arrested in a most reckless manner last Friday a day after they have grudgingly released him for just for 24 hours. They forced their way into the court room in utter contempt , violated and desecrated the hallowed temple of Justice in the most violent and repulsive manner ever in the history of disrespect to the judiciary.
The same way, Abubakar Idris popularly know as Dandiyata, a lecturer at the Federal University, Dutsinma Katsina, a critic of the APC was sent to jail for daring to speak out to challenge the government of anti-Peoples’ policies. Agba Jalingo is spending over 3 months in detention at the pleasure of the governor of Cross River State, Prof Ben Ayade for daring to demand the whereabout of about 500 million Naira the said governor was alleged to have used to birth a micro finance bank that is presently not functional. He was charged among others of the offence of planning to overthrow the State Government of Cross River State. Imagine such a charge? The most absurd is that masked witnesses who will testify behind curtains in the court room have been lined up for the trial. Meanwhile all attempt to have him on bail have been resisted by his persecutors and the court seem to agree that he does not deserve bail. We must not forget that other youths like Steven Kafeson, Jones Abiri are all in different prisons across the various States in Nigeria for writing or speaking against the government at the various States and at the centre.
No one is spared, no one is free. The human right community is clearly under heavy watch and threat. For some of us we are barely being tolerated. I was the guest of Efcc for 23 days recently. Chief Mike Ozekome SAN, the “Eze Gburugburu of Ndi Nigeria”(the title I gave to him) is my able lawyer who took measures that I will treasure the rest of my life to ensure that my rights that were violated got redressed in the court of law. Our Femi Falana SAN, I call him my worthy mentor and big uncle decried the criminalization of a matter that was purely civil between me and them. He spoke out openly in the day, in the night I was called out and asked to be released. I turned down the offer, requesting that I would rather come out in the morning rather than coming out of detention by the ungodly hour of 11 pm.

My experience in there, I will treasure the rest of my life. When I became downcast, it took the soothing words of Femi Falana SAN when he came visiting that he could remember when and how he spent 10; months in prison in the North. At that time I was already spending 18 days and feeling as if I have spent years but by the time I heard the testimony of FF SAN of spending 10 months in prison, I knew that I had better brace up for a long haul. I became strengthened when he left because I resolved that if he could spend 10 months and came out alive and he is today one of the leading human rights lawyers in Nigeria, I need his experience both theoretically and practically to appreciate the benefits of freedom and how to intensify my self imposed task of liberating people from the shackles of oppression and illegal detention. It was a big resolution for me especially when I saw so many young men who are thrown into long detention by the agency on the allegations of cyber crimes. I met some who had been there for the past three or 4 months without any arraignment or bail.
I saw first hand how the judiciary is being used by the agency and this is applicable to DSS, police etc to violate the rights of the citizens.
These agencies go to the court and obtain ex parte orders to detain citizens beyond 24 and 48 hours, extending them to some 14 days, 20 days or 30 days depending on the number of days that suit their fancy. These orders obtained exparte are usually not communicated to the defendants in question. Perhaps you are only made aware if your lawyers commences action for the enforcement of your rights in court and it is at that point they will file a counter affidavit informing the court that they have earlier on obtained a court order to detain that individual beyond the time constitutionally
guaranteed. This is clearly unfair, inhuman and wicked and should be discouraged.
My prescription on this is that the courts should refuse any such ex parte application that seeks to elongate the detention of a citizen beyond the timeline allowed by the constitution which is usually 24 or at maximum 48 hours except the defendant should be put on notice. This should be the minimum standard. However wherever the court is satisfied that the exigencies of a particular case will not permit the luxury of putting the defendant on notice and is minded to grant such ex parte orders, the Court should and must give an ancillary order that the ORDER OF THE COURT MUST BE SERVED ON THE DEFENDANT IMMEDIATELY TO LET HIM OR HER BE AWARE THAT HIS OR HER DETENTION IS BEING EXTENDED BY AN ODER OF COURT AND THIS WILL ENABLE THE DEFENDANT TO TAKE STEP OR STEPS TO HAVE THE ORDER REVIEWED OR SET ASIDE FOR SOME VITIATING FACTORS.
I have dedicated myself to ensure that we change those laws that give the prosecuting agencies the unfettered power to approach the court and obtain ex parte court orders with which they violate the rights of the citizens especially the youths.
Before I conclude let us ruminate on these historical facts concerning the political rights of the youths.

The youth have not always been on the periphery of Nigeria’s political landscape. In fact, Nigeria’s independence from Britain was won by the likes of Nnamdi Azikiwe, Mbonu Ojike, Obafemi Awolowo and Anthony Enahoro who utilized their youthful exuberance to agitate for Nigeria’s emancipation from colonial exploitation in the 1930s, 1940s and 1950s. Upon this independence, youths were immediately propelled into political leadership positions across the country. Remarkably, Mathew Mbu, Mbazulike Amechi, Maitama Sule and Shehu Shagari became cabinet ministers in their 20s and 30s.

Nigeria’s first democratic experience would be brutally cut short by a military coup d’état in 1966, but even that ushered in 6 (out of a total of 8) military juntas that were led by generals in their 30s and early 40s. However, the marginalization of the youth in Nigeria’s political space can be traced to this era of military rule.
Many of the officers who held sway in that era have refused to pass the baton and leave the scene. They have recycled themselves from soldiers to politicians and from kingmakers to the so-called elder statesmen whose approval and blessings must be sought before one can aspire to occupy any political leadership position in the country. The likes of Olusegun Obasanjo, Ibrahim Babangida, Abba Kyari and the incumbent president, Muhammadu Buhari, are still very relevant decades after their heydays in military fatigues. General Gowon was 31 years when he became the Head of State in 1966, General Murtala Mohammed was 37 years old he overthrew the government of General Gowon in 1975, General Obasanjo was 39 years old when he succeeded the government of Gen Mohammed that was cut short by military coup de’tat. Major General Muhammadu Buhari was 41 years when he sacked Shagari’s regime and took over. He is back and still at the saddle at his 70s. Major General Aguiyi Ironsi was 42 years old when circumstances entrusted leadership on him in 1966.
While nations that understand the times are electing young ones to take over the running of their countries, Nigeria’s leadership architecture is peopled with old men and women all over. I think we have an ambassador who is in his 90s and in a country where our foreign policy is critical for our survival as a nation . If not for time constraint I would have read out the average age and countries where young ones are holding sway, piloting successfully the affairs of their countries. Please permit me to quickly do this with some countries and I will round up, I promise.

Just yesterday Finland elected the youngest Prime Minister in the world presently. She is Sanna Marin who is just 34 years. Ukairian Prime Minister was elected last year at the age of 35 years. North Korean Leader KimJong-Un succeeded his father at the age of 36, El Savador elected their president early this year who is just 38 and New Zealand Prime Minister is only 39 and she is a woman. Just do the mathematics and tell me the average age of these world leaders. This is the new way to go as the world plans leadership succession in such orderly manner over to their YOUTHS to keep the world safe and better. The Nigeria’s and America’s examples are exceptions rather than the rule. You can also see their leadership style which is full of aberrations and apologies.

CONCLUSION.

The Nigerian youth should really stand up to be counted as regards their political and fundamental human rights. They should refuse to be accustomed to the gross violations of their rights, they have intimidating demographic credentials that they can use to their greatest advantage. They should insist on the application of the fundamental objectives and directive principles of state policy and the fundamental human rights provisions in our constitution. Let them resist the passage of the Social Media Regulation and the Hate Speech Bills as that will really curtail their freedom of expression over the governance of the country. They must also insist that the government of the day at the executive level should and must respect other arms of government and must not desecrate our institutions like the judiciary as that will otherwise destroy the very fabric of the country.

Ladies and gentlemen this is my little contribution to this discourse on this auspicious occasion of celebrating the Human Rights of citizens in the world. I thank the organizers for inviting me to share this podium with these great giants and patriots in Nigeria. The pleasure is certainly mine.

Increment of Capital base in insurance company crucial, Finance minister insists

The Minister of Finance, Budget and National Planning, Mrs Zainab Ahmed, on Monday said the recapitalisation of the insurance industry would reduce risk of insolvency and protect policyholders in the sector.

The minister said this in Abuja at the opening session of a meeting of the Association of African Insurance Supervisory Authorities.

The National Insurance Commission had in a circular announced new capital requirements for operators in the insurance industry.

In the circular to its regulated entities, life insurance companies’ capital was raised from N2bn to N8bn, general companies got a raise from N3bn to N10bn, while composite insurance companies’ capital was raised from N5bn to N18bn

Addressing delegates at the event, Zainab said the recapitalisation of the insurance industry was one of the many initiatives the Federal Government was implementing to reposition the sector to boost economic growth.

In view of the objectives of government for the sector, she said the recapitalisation was necessary to increase safety and soundness of the system as well as strengthen the financial position of the companies.

She also said the government was implementing the ‘no premium no cover’ policy to facilitate reduction in outstanding premium, improve liquidity position of insurance companies and ensure prompt payment of claims.

Ahmed said a financial inclusion initiative was also being implemented through micro insurance and Takaful insurance products.

This, according to her, wss intended to bring insurance services to the underserved segments of the society.

She said, “It is informative to state that a veritable approach towards a healthy competitive private sector economy is the enhancement of the structure of government-led supervisory framework.

“In other words, it is believed that where supervisors are ahead of the institutions they regulate in relation to operations and conducts, then achieving growth, volumes and impacts on the economy becomes easier.

Members of the Medical and Health Workers Union of Nigeria (MHWUN) Abia state Chapter have re-elected Comrade Okoro Ogbonnaya as their Chairman.

The election took place at Eastern Comfort Hotel, Umuahia Abia state capital on Tuesday, ABN TV reports.

Recall the state government had earlier canceled the 5th quadrennial state Conference of Medical and Health Workers Union of Nigeria (MHWUN) Abia state chapter election scheduled to hold on the 17th Day of October, 2019 at same venue.
