BREAKING: Appeal Court Affirms Diri As Bayelsa Governor

The court of appeal sitting in Owerri, Imo state on Tues dismissed an appeal filed by Ndutimi Alaibe which challenged the emergence of Douye Diri as the winner of the People’s Democratic Party (PDP) primary election in Bayelsa.

Alaibe, who was also a governorship aspirant of the PDP for the 2019 election, had instituted a suit against the party, Diri and the Independent National Electoral Commission (INEC) at the federal high court in Owerri.

The Court which on Tuesday affirmed the judgment of the lower court, dismissed the suit for lacking merit.

It would be recalled that Diri was on February 13, pronounced as Bayelsa state governor after the Supreme Court sacked David Lyon less than 24 hours before his inauguration as governor of the state.

The apex court faulted Biobarakuma Degi-Eremienyo, his running mate, for submitting forged credentials with multiple names to INEC.

Alaibe had dragged the governor and the @inecnigeria to court over what he described as a ‘flawed process’ of the PDP primary.

But a High Court judge Tijjani Ringim, had on March 10, dismissed Alaibe’s suit for lacking merit.

According to him, “Evidence available to me indicates that the process leading to the emergence of Diri as the candidate of the PDP in the September 3 governorship primaries in Bayelsa was legitimate.”

“I hereby dismiss this suit for lack of merit.”

Not satisfied with the ruling, Alaibe proceeded to the Court of Appeal.

Allow Commercial Vehicles To Operate Beyond 4pm In Aba — Groups Beg Ikpeazu

Following the relaxation of lockdown in the state by governor Okezie Ikpeazu, civil groups the Abia State Civil Societies Coalition on COVID-19 and South-East Youth Leaders have appealed to the State Government to make adjustments regarding the order prohibiting commercial vehicles to operate beyond the hour of 4pm, saying it is against the poor people living in the city.

The groups stated that the rural poor commuters who come from the local areas of the state to sell essential goods like food items at various markets in the town also find it difficult to meet the deadline set for the commercial vehicle operation, which is their only means of transportation.

In a release jointly signed by Comrade Nelson Nnanna Nwafor and Hon. Goodluck Egwu Ibem for Abia State Civil society Coalition Against COVID 19 and Coalition of South East Youth Leaders (COSEYL) respectively, they emphasised that the traffic congestion and mass hysteria that follows the closure of markets by 3:00 pm, as directed by the state government, with only one hour – 3:00 pm to 4:00pm – for commuter traders to reach home is not feasible, adding that most of the traders come from afar, in some cases from outside the city.

“The second item (number 2) of the release signed by Barr. Chris Ezem, Secretary to the State Government, on the said date (amended in part the following day – 9th May, 2020) could be anti-people, if not timely reviewed. The fact that all “commercial tricyclists (keke) operators and all other intra-state commercial transporters” are to only operate from and within the hours of 8:00 am to 4:00 pm is against the urban poor and even the rural poor commuters who come from the local areas of the state to sell essential goods like food items at various town markets. The Coalition and Leadership so posit having monitored, in Aba, the traffic congestion and mass hysteria that followed the closure of markets by 3:00 pm, as directed by the state government, with only one hour – 3:00 pm to 4:00pm – for commuter traders to reach home most of who came from afar, in some cases from outside the city but from within the state since Aba is the state’s commercial nerve centre of Abia.

“The sight of traders turned stragglers and long-distance trekkers because of gridlock and lack of commercial motorists and vehicles to convey them back home as observed yesterday in Aba was excruciating as it was painful. Again, the adjustment and guideline in ordering closure of markets by 3:00 pm and all intra-state commercial transport only an hour later by 4:00 pm, created congestion and unhealthy rush hour such that people could not get home timely and in which case many commercial vehicles, due to the traffic congestion attendant, could not beat the closure time in one hour trying to commute traders. The rush by traders to meet the 4pm deadline made it impossible for them to observe the 1.5m social distancing.

“It is instructive to state that allowing only private vehicles to operate from 6:00 am to 8:00 pm, as is the federal government’s order, could be against vast majority of the state’s populace, majority of which does not own vehicles. This seeming selected justice does not carter to all classes within the state and should, for humanity’s sake, be reviewed.

“While we understand the likely security implications of not allowing commercial motorists, especially tricyclists and minibus operators to ply the roads and routes at certain hours at least, for now, the Coalition and Leadership urge that in the interim, the operational hours for commercial vehicles be extended, in respect of the population without private cars, to at least 6:00 pm to ease unnecessary sufferings on the part of our people. It is in this that traders coming from remote areas and the commercial motorists who are equally taxpayers can have sense of justice.

“Finally, Coalition and Leadership commend the state government for all the containment measures so far, including border interceptions of smuggled persons (almajirai and others) and tracking of index cases and their contacts while as urge Abians to obey all the rules and keep to personal hygiene while we fight this war assured of victorious dawn” the statement read.

Buhari Seeks Confirmation Of 42 Career Ambassadors [FULL LIST]

President Muhammadu Buhari has asked the senate to confirm 42 nominees as career ambassador-designates.

Buhari request was contained in a letter dated May 6 and read by Senate President Ahmad Lawan on the floor of the upper legislative chamber on Tuesday.

He premised his request on section 171 of the constitution.

“In accordance to section 171 (2) (1c) and subsection 4 of the 1999 constitution of the federal republic of Nigeria as amended, I have the honour to forward for confirmation to the senate the under listed 42 names of nominees for career ambassadors-designate,” the president’s letter read.

“Copies of their curriculum vitae are attached herewith.”

The president also asked the senate to confirm two nominees for the Nigeria Deposit Insurance Corporation (NDIC) and four nominees for the Nigerian Law Reform Commission.

Diana Okonta and Yiana Kali were nominated as executive directors and non-executive directors of the NDIC respectively.

House Of Reps To Hold Two-Day Public Hearing On Infectious Disease Bill

The Speaker of the House of Representatives, Femi Gbajabiamila, has given the assurance that transparency and accountability will be upheld in the conduct of the public hearing stage of the Control of Infectious Disease Bill, 2020.

He said the public hearing, which is expected to take place in the next few weeks, would be for two days and would be physical and open to submission of memorandum and position papers from members of the public.

Gbajabiamila stated this on Monday when he received some Civil Society Organisations (CSOs) at his office in Abuja, the nation’s capital.

He told them that the effects of coronavirus (COVID-19) during and after its outbreak were of paramount concern to the House.

The speaker noted that the House would step up its oversight responsibility on issues and palliative programmes around COVID-19, and the 9th Assembly’s Legislative Agenda would be rejigged to reflect the realities of the pandemic.

While stressing that the House would continue to observe its weekly sitting and add more days where necessary, he insisted that the lawmakers would continue to pass critical legislation during the COVID-19 period.

The lawmaker said, “On the Control of Infectious Disease Bill, we are aware that many of the comments it generated are genuine; some were political and some were clearly based on the misunderstanding of the bill, but we cannot ignore any and that is why we are taking it to the public hearing.

“It is going to be conducted over two days and because we don’t want to endanger anyone’s life, all the COVID-19 protocols would be observed in a hall that is supposed to take 300 people, we will have about 40.”

“Those who could not make it the first day would have the opportunity to be there the second day. The public hearing would be physical because this is all about transparency and accountability.

“We don’t want to endanger the lives of Nigerians. It will be beamed live on TV and radio but those that cannot make it to the public hearing will have the opportunity of sending their memorandum to the House,” he added.

According to the speaker, the bill that will be passed by the House will be the aggregate of the submissions of Nigerians.

Earlier, the leader of the delegation, Clement Nwankwo of Policy and Legal Advocacy Centre (PLAC) commended the lawmakers for rising to the occasion.

The House, according to him, has shown leadership in consultation regarding the pandemic and taken some positive steps to address the issues of concern.

Also at the meeting were the Majority Leader of the House, Hassan Ado-Doguwa; the Chief Whip, Muhammad Monguno; the Deputy Minority Whip, Gideon Gwani; and the House Committee Chairman on Defence, Babajimi Benson.

Others included the Executive Director of Civil Society Legislative Advocacy Centre (CISLAC), Auwal Rafsanjani, the Chief Executive Officer of Women Trust Fund, Mufuliat Fijabi; and the Executive Director of Youth Initiative for Advocacy Growth and Advancement (YIAGA), Samson Itodo.

“You Have Betrayed Almajirai After Using Them To Get Power” – PDP Blasts Buhari, APC

The Peoples Democratic Party, PDP has accused the President, Muhammadu Buhari, and the All Progressives Congress, APC of betraying Almajirai and Nigeria’s poor and vulnerable after using them to grab power in 2015.

The National Publicity Secretary of the PDP, Kola Ologbodiyan, said this in a statement in Abuja, on Monday.

The party noted that the APC and its regime had continued to show their true colours especially as manifested in the neglect and dehumanising treatment they had meted out to poor and vulnerable Nigerians since the outbreak of the COVID-19 pandemic.

The statement read in part, “The PDP notes that APC’s disdain and desertion of our citizens had further exposed it as a deceitful party which used lies, propaganda and false promises to mislead the people in 2015 to denounce a system of governance which had their interest at heart and worked day and night to ensure a better life for them.

“Today, the APC and its government have succeeded in wrecking the lives of ordinary Nigerians; stolen their common patrimony; rendered many homeless, turned their joy into sadness, hope into hopelessness, fortune into abject poverty; reneged on all their enticing promises, swindled and abandoned our citizens to a life of misery.

“From Katsina to Lagos, Kano to Edo, Kaduna to Osun, Yobe to Ekiti; Plateau to Kogi and all the places where the APC has left footprints at the federal and state levels, the downtrodden people have been exploited and now abandoned; treated by the APC as sub-humans in their own country.”

It also accused APC leaders of taking delight in insulting Nigerian youths who they denied job opportunities calling them lazy and unemployable.

Ologbodiyan noted that the same APC derided the then PDP administration which took the initiative towards solving the almajirai problem once and for all.

He further said, “Unfortunately, what we witness today are totally reneging on these promises, degradation of citizens, hunger and starvation, intimidation of dissenting voices, untold corruption, neglect of our infrastructure, the annexation of the electoral and judicial system, violation of human rights, in addition to the escalation of insurgency and bloodletting while the President, who promised to lead from the front, recedes very far into the luxury and safety of Aso Presidential villa.

“Nigerians can recall how the PDP championed the cause of the downtrodden, established Almajirai schools, the e-wallet initiatives for rural farmers, built new universities, revamped our economy, overhauled our health care system, established the National Health Insurance Scheme, revamped the mortgage system to give Nigerians access to own homes and expanded the political space to promote youth and women participation in governance, among others.”

The PDP accused the APC of reversing all those gains within a five year period. It maintained that the COVID-19 pandemic had further exposed the APC as a party without plans for Nigerians, which only came to grab power to enrich themselves at the expense of ordinary Nigerians.

The party urged Nigerians not to despair, but to rally among themselves, help each other and ensure that a party like APC, did not come to power at any level after the end of this tenure.

“On our own part, the PDP as a party will continue to stand with Nigerians, especially the downtrodden and remain committed to protecting their interests at all times,” the statement added.

In response, the National Publicity Secretary of the APC, Mallam Lanre Issa-Onilu said, “The baseless accusations of the PDP have become familiar. However, let them know that the almajirai system is not an APC policy, he should talk to the states.”

Bayelsa Intercepts Two Busloads Of Almajiri

The Bayelsa State government on Monday intercepted and sent back another two busloads of Quranic education pupils, more popularly known as “Almajiri” at the Glory Land entry point into Yenagoa.

Freston Akpor, the Permanent Secretary of the Ministry of Information and Orientation and also a member of the state’s Covid-19 Taskforce, said that in quick response, the operatives stationed at the entry point ordered that the Almajiri children be taken back in the same busloads conveying them.

According to Akpor, the buses were intercepted by a team of task force officials led by Akpoebi Agberebi with a team of security operatives on enforcing the “No Entry” directive of the government at the border.

According to the members of the State Task Force on Covid-19, the Almajirai was made up of young boys of various origins from the Northern states.

“While some of the Almajirai claimed they were on their way to the state on a commercial fishing expedition, others claimed to be on the way to Port Harcourt, Rivers State.”

Akpor, however, confirmed that the 17 persons, including their drivers, were escorted to Patani, the border between Delta and Bayelsa states.

Dollar Sells For N445 As Forex Scarcity Persists

The dollar exchanged for N445 in the parallel market on Monday due to scarcity and shrinking liquidity in the forex market.

The extension of the ban placed on flights in the country by the Federal Government, as part of efforts to curtail the spread of coronavirus, further affected the access to forex by the bureau de change operators.

The President, Association of Bureaux De Change Operators of Nigeria, Alhaji Aminu Gwadabe, said, “The extension of airport lockdown as well as the sale of forex to the BDCs pending when air travels resume has impacted the naira negatively from N425/$ to $445/$ in the parallel market.

“However, the assurances of the CBN governor to foreign investors on ease of exit have helped to flatten the curve at N445/$ without any sign of further depreciation at the close of business today.

“The persistent dollar scarcity with shrinking liquidity in the market is one of the major unintended consequences of the shutdown of the BDCs window.”

Deposit Money Banks had however commenced forex sales to customers wishing to pay school fees and the SMEs making essential imports needed to revamp economic activities across the country.

This followed the commencement of forex sales by the Central Bank of Nigeria to all commercial banks for sale to parents and the SMEs as part of efforts to gradually ease the effects of the COVID-19 lockdown.

The CBN stated that it had resumed the provision of over $100m per week for school fees and the SMEs.

Unity Bank Plc said in a statement that it had received the supply of foreign exchange from the CBN to adequately meet eligible demands from customers.

ABCON stated that it was important for the CBN to resume the sale of forex to the BDCs in order to defend the value of the naira and infant industries.

The Director, Corporate Communications, CBN, Isaac Okorafor, had stated, “The CBN has also made complete arrangements to resume foreign exchange sales to the BDC segment of the market for business travels, personal travels and other designated retail uses, as soon as international flights resume.”

P&ID: US Judge Grants Nigeria’s Request To Access Bank Statements Of Jonathan, Diezani

P&ID: A New York judge has granted Nigeria’s request to subpoena 10 banks in the US regarding access to bank account statements of some of Nigeria’s former top public officeholders.

In September 2019, a UK court awarded $9.6 billion against Nigeria in favour of Process and Industrial Developments Ltd (P&ID).

In a bid to overturn the $9.6 billion arbitration award, as reported by Bloomberg, the federal government filed an application before the US court seeking permission to subpoena information on transactions involving top government officials, including former President Goodluck Jonathan and his wife, Patience; former ministers of petroleum, Diezani Alison-Madueke and Rilwanu Lukman.

But the former president had said he has no foreign bank account.

According to Abubakar Malami, the attorney general of the federation, “there is good reason to believe that ministers at the highest level were involved in a corrupt scheme to steal money from Nigeria”.

He said P&ID had no ability or intention of ever performing the contract, which required the company to build a gas processing plant and the government to supply gas.

He said P&ID paid kickbacks to government officials so that they could overlook the company’s lack of technical capabilities in executing the contract which was never started.

Ruling on the application on Thursday, Lorna Schofield, the judge held that Nigeria’s request met the standards of the law.

But the court rejected Nigeria’s request to conceal its findings from P&ID.

The judge ordered that Nigeria must grant P&ID access to the documents received from the subpoena.

The banks involved are: “Citibank, N.A. (Citibank), Allied Irish Banks plc (Allied Irish), HSBC Bank USA (HSBC), Standard New York, Inc. (Standard New York), Deutsche Bank Trust Co. Americas (Deutsche Bank), J.P. Morgan Chase (JPMorgan), United Bank for Africa (UBA), Bank of Cyprus, Fortis Private Banking Singapore Limited (Fortis), and Standard Chartered International (USA) Ltd. (Standard Chartered)”.

The Nigerian government said the 10 banks are “likely to have processed US dollar transactions connected to P&ID’s operations as either correspondent banks or the New York branches of foreign lenders”.

P&ID’s spokesperson described the request for a subpoena as “a desperate attempt to substantiate Nigeria’s spurious allegations of fraud”.

The Economic and Financial Crimes Commission (EFCC) is prosecuting James Nolan, Adam Quinn (at large), and two firms in which they are said to be directors – Goidel Resources Limited, and ICIL Limited on 32 counts of fraud — linked to the P&ID case.
