Drug Deal: NDLEA Arraigns Abba Kyari As Co-Defendants Plead Guilty

The National Drug Law Enforcement Agency, (NDLEA) on Monday produced the suspended Deputy Commissioner of Police (DCP) Abba Kyari, and six others over alleged drug trafficking.

Those charged with Kyari are ACP Sunday Ubua, ASP Bawa James, Inspectors Simon Agirigba, John Nuhu, while ASP John Umoru is said to be at large.

The others are Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwanne.

When the eight-count charges were read to the defendants, two of the defendants, Umeibe and Ezenwanne pleaded guilty to the offences, but Kyari and the officers denied the offences.

Kyari was declared wanted by the NDLEA after it obtained video footage of him negotiating a drug deal with its investigators.

The other defendants were arrested on January 19 at the Akanu Ibiam International Airport, Enugu that they have admitted to being drug couriers.

In the charges, Abba Kyari, ACP Sunday Ubua, ASP Bawa James, Inspector Simon Agirigba, and Inspector John Nuhu, all of the Intelligence Response Team (IRT) were said to have dealt in 17.55 kilogrammes of cocaine between January 19 and 25 and committed an offence contrary to and punishable under section 14(b) of the NDLEA Act, CAP 30 Laws of the Federation of Nigeria 2004.

Umeibe and Ezenwanne were alleged to have unlawfully imported 21.35 kilogrammes of cocaine on or about the 25th January 2022 at Akanu Ibiam International Airport, Enugu, Nigeria, which is an offence contrary to and punishable under section 11(a) of the NDLEA ACT CAP N30 Laws of the Federation of Nigeria 2004.

Count eight reads, “That you DCP Abba Kyari, on or about 25th January 2022, at a restaurant on Port Harcourt Crescent, Area 11, Garki Abuja, within the jurisdiction of the court, attempted to obstruct the agency and its authorised officers in the exercise of their duties by offering the sum of USD 61,400.00 USD (sixty-one thousand, four hundred United States of America Dollars) to a senior officer of the agency as an inducement to prevent the testing of the 17.55kilogrammes of substance used to replace the cocaine seized from Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwanne and thereby committed an offence contrary to section 23 and punishable under section 49 of the National Drug Law Enforcement Agency Act Cap N30 Laws of the Federation of Nigeria 2004.”

The suspended Deputy Commissioner of Police, DCP, Abba Kyari, who is facing a drug trafficking charge, on Monday, begged the Federal High Court sitting in Abuja not to remand him in prison custody.

Kyari, through his lawyer, Mr. Kanu Agabi, SAN, prayed the court to allow him to remain in the custody of the National Drug Law Enforcement Agency, NDLEA, pending the hearing and determination of his fresh application for bail.

The embattled DCP, who hitherto headed the Police Intelligence Response Team, IRT, made the request after he pleaded not guilty to an eight-count charge the NDLEA preferred against him and six others.

He was docked before trial Justice Emeka Nwike, alongside four other police officers- ACP Sunday J. Ubia, ASP Bawa James, Insp. Simon Agirigba and Insp. John Nuhu, as well as two alleged drug traffickers that were arrested at the Akanu Ibiam International Airport in Enugu, Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwanne.

Whereas Kyari, dressed in blue native attire, and his police Co-Defendants, pleaded not guilty to the charge, the 6th and 7th Defendants, Umeibe and Ezenwanne, pleaded guilty to allegations against them.

Meanwhile, shortly after the Defendants entered their plea, the NDLEA, through its Director, Prosecution & Legal Services, Mr. Joseph Sunday, applied for a trial date and for review of facts in respect of the Defendants that pleaded guilty to the charge.

The NDLEA equally told the court that it filed a counter-affidavit to oppose the release of Kyari and the other four former members of the Police IRT, on bail.

However, Agabi, SAN, while arguing that the charge against the Defendants contained bailable offences, he urged the court not to accede to request for facts in respect of Umeibe and Ezenwanne.

Agabi, SAN, contended that it will be prejudicial to his client for facts of the case to be reviewed and a decision reached on it, while the trial is still subsisting.

He further made reference to cases where Defendants, out of ignorance, pleaded guilty to a charge against them.

“It is not in the interest of justice for the facts to be reviewed while the trial is still ongoing”, he added.

He noted that both Umeibe and Ezenwanne were also mentioned in some counts in the charge that involved Kyari and the others.

On his part, the Prosecution counsel, Mr. Sunday, maintained that reviewing the facts of the case would not prejudice DCP Kyari and the others.

“My lord, this sort of application by the Defence is to undermine the capacity of this court.

“This case is to be considered on the basis of the evidence before the court. I do not see how the 1st to 5th Defendants will be prejudiced since we are going to confront them with evidence against them”

“The most proper thing is to dispose of the case against the 6th and 7th Defendants.

“It will be unjust and unfair to keep the two Defendants in custody while waiting for the conclusion of the trial of the others.

“It is better for them to be convicted to enable them to start serving their sentence”, the Prosecution added.

After he had listened to oral arguments from both sides, trial Justice Nwite said he would want the parties to formally address the court on the issue next Monday.

Kyari, who was brought before the court by armed operatives of the agency, is currently taking his plea to an eight-count charge that was preferred against him and six others.

Husband In Trouble As Eyes, Tongue, Others Miss From Late Wife’s Corpse

There was tension in Ogbe-Ani, Ubulu-Uku community, in the Aniocha South Local Government Area of Delta State following the rejection of a corpse that was brought without eyes, tongue and other organs.

The deceased, Mrs Comfort Biakpara, who was in her early 50s, was said to have been brought to her family compound in Ubulu-Uku by her husband, who hailed from the Burutu Local Government Area of the state.

The deceased was laid in her compound on Saturday for internment when it was discovered that some vital organs were missing.

A family source told our correspondent that the incident created apprehension in the community, as youths and elders said the corpse was not their daughter.

“It was terrible yesterday (Saturday). Our sister was brought without eyes, tongue and other organs.

“As they laid our sister on a bench in the canopy and family members and other people were going to see her, unfortunately, we first discovered that cotton wool was put on her eyes.

“When we raised the alarm and enquired further, we discovered that there were no eyes and that was when youths revolted and started scattering everywhere. Some sustained minor injuries in the process.

“The husband’s family members who brought the corpse ran away because we were angry over the development. Later, we found out that even her tongue was also removed,” the source said.

The source disclosed that the deceased’s husband was not present.

It was learnt that the corpse was abandoned at the canopy till around 8pm when it was taken to a morgue with the help of some vigilantes in the community.

The source said the family was set for a showdown with the victim’s husband.
