Police Shielded Abba Kyari From Facing Numerous Allegations Against Him Since 2008, Thank God He Finally Faces Justice — Ojukwu

The Executive Secretary of the National Human Rights Commission, NHRC, Mr. Anthony Ojukwu, SAN, has revealed how suspended Deputy Commissioner of Police, DCP, Abba Kyari, was shielded from facing numerous cases that were filed against him since 2008.

Ojukwu, who spoke at a capacity building retreat of the House of Representatives Committee on Human Rights, organised by the Policy and Legal Advocacy Centre, PLAC, further disclosed that all the petitions against DCP Kyari, bordered on human rights violations.

The NHRC boss lamented that despite several invitations extended to Kyari who is currently in custody of the National Drug Law Enforcement Agency, NDLEA, police authorities refused to allow him to appear before the commission.

“I summoned Abba Kyari up to eight times, but the authority shielded him. Everytime they will say that he travelled to Lagos, Kaduna or somewhere else.

“He had so many issues and cases that were brought against him, pending before the Commission.

“Since 2008 to 2009, we have been summoning this officer because he had so many petitions against him. But he was celebrated as a super cop.

“Thank goodness that God has used another way to bring him into account”, Ojukwu added.

He urged those that occupy positions of authority, including the federal lawmakers, to be mindful of their conduct, saying “the days of impunity are gone”.

“If you do anything while in power, you will definitely answer for it no matter how many years it takes,” Ojukwu stated.

Earlier in his remarks at the retreat, human rights lawyer, Femi Falana, SAN, said there was need for Chief Magistrates in the country, to in line with the provision of section 34 of the Administration of Criminal Justice Act, ACJA, 2015, pay periodic visit to detention facilities across the federation.

Falana, emphasised that under extant laws in the country, no one should be arrested in lieu of another person, adding that all confessional statements must be recorded in the presence of a lawyer.

He further warned against the use of torture by security agents to extract statements from suspects.

“The law as at today is very clear. If anyone is tortured, the penalty is 25 years imprisonment without option of fine”.

Stressing that it is a criminal offence for hospitals not to treat someone with gunshot wound, Falana, SAN, further called for an end to the parading and seizure of passport of suspects, insisting that it is illegal.

“No security agency has the right to seize your passport. It has gotten so worse that these days, you may not even be aware. You will be travelling out and you will be told that your name is in what they call the watchlist.

“My name has been there since 1984. There must be a court order before your passport could be seized”.

Recalling that his passport was once seized for over four months, Falana, SAN, said: “From 1987 to 1997, I never travelled through the airport. I had to pass through Cotonou route which people now call NADECO road.

“One day, I came back to the country, they detained us and asked for our passports. I told them that I left it in Cotonou. They detained us.

“Up till today, passports are still being seized. We cannot operate like that. The court has said that nobody should be declared wanted without a court order, but they still do so.

“There are judgements that nobody should be paraded, especially someone that is presumed innocent. But what is happening today?

“Ordinary people are being paraded, but many of those that stole millions are never paraded”, Falana noted, even as he accused Police of engaging in what he termed as “commercialization of liberty”.

The Executive Director of PLAC, Mr. Clement Nwankwo, said the essence of the retreat was to equip the House of Reps Committee on Human Rights to become more responsive to petitions from citizens.

“Committees on Human Rights in both the Senate and the House of Reps have a a lot of work to play in protecting the right of citizens”, Nwankwo added.

In his welcome address, the Chairman, House Committee on Human Rights, Hon. John Dyegh, said the retreat was a platform for stakeholders to deliberate, review previous resolutions and proffer workable solutions to some of the human right challenges facing the country.

Soludo revealed this while answering questions on Arise TV on Tuesday monitored by ABN TV.

According to the former Central Bank Governor, he has inherited debts running into “hundreds of billions of naira” from his predecessor, Willie Obiano, according to audited accounts.

Soludo said: “In terms of debt I inherited, it runs into hundreds of billions of Naira. In that of cash, we met about 300 million Naira only. In fact, let’s not talk about it. Our treasury is funny.

“I hope we shall make money henceforth to help us fulfil our promises for infrastructure and development of the state.

“But in terms of what I met in our coffers, my brother, it’s pathetic. Please let us not go there. God will help us”.

Recall that the immediate past governor Obiano was apprehended by operatives of the Economic and Financial Crimes Commission (EFCC) as he tried to leave the country on the same day he handed over to Soludo. Though the reasons, why he was arrested, is yet to be revealed but there are rumours of misappropriation of funds.

An independent investigation panel on fixed March 30 for the suspended DCP Abba Kyari to appear in a petition of alleged unlawful arrest filed by three persons.

The Panel is investigating the allegations of human rights violations by the defunct Special Anti-Robbery Squad (SARS) and other units of the Nigerian Police.

The petitioners, Ambrose Mairungu, and Blessing Dung, in a petition, marked 2020/IIP-SARS/ABJ/205 alleged that Yakubu Danjuma, Ibrahim Daniel, and Choji, Dung’s husband were unlawfully arrested, detained, tortured, and received inhuman treatment by Kyari.

The panel on March 11 ordered the Chairman, National Drug Laws Enforcement Agency (NDLEA), retired Brig.-Gen. Buba Marwa to produce Kyari on March 22, to defend himself.

However, in response to that order, and administrative letter was written to the chairman of the panel by Mr Abdullahi Haruna, SAN, counsel to Kyari.

He is requesting that all petitions where Kyari’s name was mentioned be made available to enable him study it and respond appropriately.

He, therefore, prayed the panel to afford him with the proceedings on such cases and prayed for a grace of two months.

Mr Garba Tetengi, SAN, who represented the chairman, retired Justice Suleiman Galadima, said the panel does not have the luxury of time but can grant him a week.

He then adjourned the hearing and cross-examination of PW1 and 2 until March 30 .

In the petition, Dung, wife to the third victim told the panel that on December 17, 2019, her husband received a phone call from his friend, Danjuma for a meeting outside the house.

“I followed my husband outside and I sighted two tinted-glass vehicles with IRT written on them.

“I saw armed police officers who came out from the vehicles, cuffed my husband, shot in the air, and drove off with him,” she said.

She also prayed the panel to award N10 million in compensation.

HURIWA Faults South-East Govs Over Insecurity, Leadership Vacuum

Civil rights group, Human Rights Writers Association of Nigeria (HURIWA), on Tuesday completed court processes asking the Federal High Court in Umuahia to stay execution of its earlier judgment ordering the deletion of Section 84(12) of the amended Electoral Act.

The group filed a stay of execution of the said judgment of the Federal High Court to enable them challenge the judgement at the Court of Appeal.

Section 84(12) of the amended Electoral Act bars political appointees at any level to vote or be voted for “at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election”.

According to Justice Evelyn Anyadike, such a clause was unconstitutional.

Her judgement therefore makes it possible for appointees of government to be nominated as delegates who can either vote in convention or congresses or be voted for while still holding their positions.

According to her, a political appointee is required by the constitution to resign 30 days to election where he or she is a contestant and not before convention.

Not satisfied by the judgment, HURIWA on Monday through its counsel, Perfect Okorie, informed the court of the motion of Appeal filed to that effect.

Listed in the motion include the Attorney General of the Federation as defendant/respondent; Nduka Edede as Plantiff/Respondent.

President Muhammadu Buhari had while signing the amended Electoral Act on February 25, this year, said he would approach the National Assembly to amend the provision in 84 (12) on the ground that it violated the constitution.

The President had said: “Section 84 (12) constitutes a disenfranchisement of serving political office holders from voting or being voted for at Conventions or Congresses of any political party, for the purpose of the nomination of candidates for any election in cases where it holds earlier than 30 days to the National Election.

“The section provides as follows: ‘No political appointee at any level shall be voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election.’

“This provision has introduced qualification and disqualification criteria that ultra vires the Constitution by way of importing blanket restriction and disqualification to serving political office holders of which they are constitutionally accorded protection.

“The practical application of Section 84(12) of the Electoral Bill 2022 will, if assented to, by operation of law, subject serving political office holders to inhibitions and restrictions referred to under Section 40 and 42 of the 1999 Constitution (as amended).”

Several opposition figures have however kicked against the deletion of section 84 of the newly signed Electoral Act.

They argue that it gives an appointed official of government an undue advantage to remain in office while pursuing political ambitions, a situation that can relegate governance to the back seat.

Assistant Inspector-General of Police (AIG) in charge of Zone 9 Headquarters, Umuahia, Mr. Isaac Akinmoyede has met with its officers in Ebonyi Command, urging them to avoid any unlawful attitude against the Nigeria Police Force, NPF.

Akinmoyede also urged the personnel to sustain their loyalty to the Federal Republic of Nigeria and be committed in discharging their duties.

The AIG gave the advice on Tuesday in Abakaliki during his interaction with the officers in Ebonyi command.

ABN TV recalls that the Junior Police officers had planned to embark on a warning strike on March 26, to protest against their poor working conditions.

Other issues include poor salaries, lack of genuine welfare benefits, and outdated weapons.

On the planned strike action, he maintained that the information about the purported strike was fake and mischievous.

“It is a rumor. But when you hear rumors at times there is need to clear the air and that is what I have come to do.

“The Officers and men have challenges but there are already plans to improve their well-being including facility, housing, and salary amongst others.

“There is need to be committed to duties and be loyal to the Federal Republic of Nigeria and the police force,” the AIG added.

Mr Aliyu Garba, Commissioner of Police, Ebonyi Command, assured the Inspector-General that the command would not join the bandwagons.

“Ebonyi will not join bandwagons in the name of strike. We will continue to do our best in the discharge of our civil responsibilities,” Garba stated.

He noted that the police personnel in Ebonyi Command were service-oriented stressing there would be no strike in the state.

Mother Who Set 10-Year-Old Daughter Ablaze Arrested

A mother of five has been arrested by the Ogun State Police for setting her 10-year-old daughter ablaze.

The command’s public relations officer, Abimbola Oyeyemi confirmed this in a press statement on Tuesday.

“The suspect, Aisha Tijani was arrested following a report lodged at Mowe divisional headquarters by one Moroof Ayinde, who reported that the suspect who lives in the same house with him poured petrol on her little daughter and set her ablaze.”

” He stated further that, the woman got annoyed because the little girl took a phone she seized from one of her children from where she kept it and gave it back to the child whose hand the phone was seized,” he said

He said that upon the report, the Divisional Police Officer, Mowe division, CSP Folashade Tanaruno quickly moved to the scene with the detectives and got the suspect arrested.

The victim, who had been badly burnt was said to have been rushed to the nearest hospital from where she was referred to Olabisi Onabanjo teaching hospital for proper medical attention.

On interrogation, the suspect, who claimed to have been separated from the father of the children, explained to the police that she didn’t know what came over her when she was carrying out the act.

The commissioner of police, CP Lanre Bankole, has however ordered the immediate transfer of the suspect to the state criminal investigation and intelligence department for further investigation.

The Imo state governor, Hope Uzodimma, has vowed to punish any civil servant who stays at home on Mondays of every week.

The State Commissioner for Information and Strategy, Declan Emelumba, made this known to newsmen in Owerri, on Monday, while reacting to the report that there was a sit-at-home order in the state.

He said that the government has not issued any sit-at-home order in the state, adding that the government has made adequate security for workers to go to work and carry out their responsibilities.

According to the Commissioner, “The government of Imo State has warned civil servants to ignore any call not to go to work on Monday or be ready to be punished for staying away from the office. Adequate arrangements for security is put in place to ensure they are in the office to do their work.

“This is to inform all indigenes and residents of Imo state that Government has not authorised any public holiday or sit at home across the state, either today, Monday, March 21, 2022, or any other working day.”

“Consequently, everyone is advised to go about his or her normal duties. Civil servants are particularly advised to ensure that they are in their offices discharging their responsibilities. Those who abstain from duty without authorisation will be sanctioned accordingly. Government hereby assures all indigenes and residents of adequate security as they go about their lawful activities,” the government said

Nigerian Correctional Service Dismisses 9 Officers, Retires 25 Others

Officials of the Nigerian Correctional Service, NCS have threatened to embark on strike over what they described as meagre salaries and poor working conditions.

It was gathered that some aggrieved officials complained over their alleged neglect by the Federal Government despite the hazardous nature of their work.

In a document obtained by journalists on Tuesday in Uyo, the aggrieved workers accused the Federal Government of paying more attention to inmates and the correctional facilities across the country without consideration for the welfare of those manning the inmates and the facilities.

They urged President Muhammadu Buhari to set up a welfare committee that will look into their welfare saying they do not have a service commission or effective representation in the National Assembly.

The document stated, “Now the big question is, why (is) all the attention of the Federal Government focusing on the inmates, buildings and others, then neglecting the welfare of the officers employed to take care and correct the inmates in line with the Mandela’s rule?

“In line with the United Nations standard minimum rules (Mandela’s rules), the correctional officers are well paid and taken care of in all capacities to enable them carry out their legitimate responsibilities for the betterment of the inmates and the nation. But here in Nigeria, the reverse is the case.

“Our salaries and allowances are very poor, both senior and junior officers. We are traumatized to the extent that recently some staff commited suicide due to neglect and poor welfare. If this issue is not addressed, we are left with no option but to go on strike.

“We want to draw the attention of the Federal Government that the modus operandi of the NCS must be changed to be commensurate with the new nomenclature. Officers and men should experience the correction firstly in different areas of their livelihood. They should be trained overseas to be able to adapt to system of operation for better productivity and to reduce cases of recidivism.

“Accommodations of the NCS officers both senior and junior are eyesores except those officers who are very lucky to work in Akwa Ibom Command and Ikot Ekpene custodial centre. Thatch/mud houses are still used as accommodation by the NCS officers in different parts of the country. No befitting barracks.

“The Nigerian Correctional Officers and men did not receive a diem and palliative from the Federal Government throughout the Covid-19 lockdown, but we are still committed to our duties, caring for the inmates, providing guards and security to all the correctional centres to avoid any unusual occurrences to the facilities in Nigeria.”

However, the NCS Public Relations Officer, H.U Chukwuedo, denied knowledge of any strike threat by the officers.

“Well I’m not aware of any threat by our officers to go on strike and I’ve not even got the lead from any quarter that any of our staff is protesting over anything,” he said.

The Special Adviser to the President on Media and Publicity, Femi Adesina, said this in a statement titled “Destabilization: PDP Gives Itself Away”.

He urged the PDP to rather work for harmony and cohesion in the country instead of thinking about the outbreak of an uprising worse than EndSARS, which he said signified murder, mayhem, mass destruction, and cannibalism.

He said the PDP had given itself away as being interested only in the destabilisation of the country to sneak its way back to power.

Adesina said: “Less than 24 hours after the Department of State Services (DSS) raised alarm about sinister plots by some elements to cause disorder in the land, using the energy crisis as a smokescreen, the PDP issued a statement, saying; ‘Our party fears that the situation is getting to a boiling point and can trigger a nationwide agitation that might be worse than the October 2020 EndSARS if not addressed immediately.’

“Which patriotic political party or organization ever threatens its country with anarchy, social upheaval and disorderliness, except one still smarting from its snout being yanked from the honeypot, as happened to PDP in 2015?

“But we wish to remind the now tepid opposition party that it was Nigerians that gave it the boot seven years ago, and those same Nigerians have not forgotten the travails they experienced, at a time the country was awash with money: no power, no infrastructure, insurgents ran riot round the nation, and our collective patrimony was looted blind. Those same Nigerians are not ready for another PDP misrule, not now, and perhaps not for a long time to come.

“Rather than plot and encourage “agitation worse than October 2020 EndSARS,” which it may well be conceiving, the PDP should work for harmony and cohesion in the country, if it ever understands such concept.

“EndSARS signified murder, mayhem, mass destruction, even cannibalism. PDP now wishes Nigeria something worse.
“A presidential aspirant of the PDP has warned that the party would die by 2023, unless it wins the Number One position in the country. And die it would, if the party wishes the country nothing except something worse than EndSARS.”

The PDP National Publicity Secretary, Hon Debo Ologunagba, had in a statement issued on Sunday, warned that there was a limit to what the people could bear under an administration that remained arrogant, inhumane, unconcerned, and insensitive to their plights occasioned by its misrule.

“Is it not an unpardonable dereliction of duty that while the nation is in turmoil and agonizing under a collapsed national grid, protracted fuel crisis, distressed aviation sector, plummeting currency, crippled production and commercial activities, President Muhammadu Buhari remains aloof and “absent” as always?

“The failure by President Buhari, who also doubles as the Minister of Petroleum Resources to take immediate action, other than the snobbish stance by his Presidency that “heavens will not fall” because of fuel scarcity amounts to daring Nigerians to do their worse.”
