Court Stops Kano APC Executives From Sacking Ganduje

A Kano Federal High Court, presided over by Justice A. M Liman, has granted an order restraining the executive members of the All Progressives Congress (APC) in Ganduje Ward from suspending the party’s national chairman, Abdullahi Ganduje, pending the hearing and determination of a suit filed by the former governor.

Ganduje, through his counsel, Barrister Hadiza Nasir Ahmed, had approached the court seeking the enforcement of his fundamental rights to fair hearing and freedom of association, as enshrined in the Constitution of the Federal Republic of Nigeria, 1999.

The court granted the order after hearing an ex-parte application moved by Ganduje’s lawyer. The judge directed all parties to maintain the status quo and stay all actions in respect of the matter pending the hearing and determination of the motion on notice.

The respondents in the suit include Basiru Nuhu Isah, the Nigeria Police Force, the Commissioner of Police, Kano Command, the Inspector General of Police, and the Department of State Service.

The court has fixed May 9, 2024, for the hearing of the substantive application.

Order of the Court: All the respondents, their servants, agents, or privies are hereby restrained from implementing and or giving effect to the purported decision reached during the purported Emergency Meeting of the alleged Executive Members of APC Ganduje Ward, on April 20, 2024, pending the hearing and determination of the substantive application for the enforcement of fundamental rights of the Applicant.
