Appeal Court Affirms Judgement Banning FRSC From State Roads

The Federal Court of Appeal in Asaba, Delta State, upheld the Federal High Court’s decision barring the Federal Road Safety Corps, FRSC, from operating on state and municipal highways in Nigeria.

Remember that in 2019, a Federal High Court sitting in Warri ordered that the FRSC may only function on federal roadways.

It ruled that the Corps had no legal authority to operate on state and local government highways.

Dissatisfied with the ruling, the FRSC filed an appeal with the Court of Appeal.

Justice E. Nwite denied the FRSC’s appeal on Monday and limited the Corps’ operations to only federal roadways in various areas of the country.

In a statement released by the Nigeria Television Authority, NTA, on Twitter on Tuesday, the FRSC stated that it would appeal the Appeal Court’s decision.

The FRSC Corps Marshal, Dauda Biu, indicated that the Appeal Court’s decision suggests that FRSC employees will no longer rescue crash victims on routes other than federal roadways.

He said, “As soon as we obtain the copy of the judgment, we would take time to look at it and make an informed decision on it. Until then, we urge the public to remain calm.”
