The Supreme Court has affirmed Ikechi Emenike as the governorship candidate of the All Progressives Congress (APC) in Abia State.

A five-member panel of the supreme court led by Tijani Abubakar on Thursday affirmed the judgment of the court of appeal delivered in December 2022.

The Abia APC had held parallel governorship primaries that produced Uche Ogah and Emenike as candidates of the party.

On May 26, the APC declared Emenike the winner of the governorship primary in the state.

On November 11, Binta Nyako, a federal high court judge, sacked Emenike and ordered INEC to recognise Ogah as the party’s governorship candidate in the state.

Both APC and Emenike had filed separate appeals challenging the verdict delivered by Nyako.

Dan Eke, another aspirant, also filed an appeal challenging the judgment of the trial judge that recognised Ogah’s candidacy.

In December 2022, the court of appeal sitting in Abuja affirmed Emenike as the party’s candidate.

In the unanimous verdict, Olabisi Ige, who led the appeal court panel, read out the names of the party members sent by the APC national secretariat to conduct the governorship primary that produced Emenike, affirming that the exercise was valid.

Another candidate, Dan Eke, also filed an appeal in which he contested the trial judge’s decision to recognize Ogah’s candidacy.

The court of appeal in Abuja confirmed Emenike as the party’s nominee in December 2022.

Olabisi Ige, who presided over the appeal court panel, read aloud the names of the party members appointed by the APC national headquarters to oversee the governorship primary that produced Emenike and affirmed the validity of the process in the unanimous decision.

Yahaya Bello’s ADC Arrested, Detained In Abuja

The police have detained a female police officer who was the aide-de-camp to the embattled former Kogi State Governor, Mr Yahaya Bello, over allegations of being part of the security aides that obstructed the arrest of the former governor in Abuja.

The ADC was arrested alongside other police officers attached to Mr Bello. They are being detained at the State Criminal Investigation Department in Abuja.

Sources within the Police say their arrests and detention followed an order by the Inspector General of Police, Olukayode Egbetokun, directing their immediate withdrawal from the former governor.

The source who spoke to our correspondent on the condition of anonymity explained that the officers were arrested on the suspicion that they deliberately aided and abetted Bello’s escape from operatives of the Economic and Financial Crimes Commission, who had gone to effect his arrest at his Abuja home on Wednesday.

The Inspector-General of Police had on Thursday ordered the withdrawal of all police officers attached to Mr Bello.

The Nigeria Immigration Service has also placed Mr Bello on its watchlist for conspiracy, breach of trust, and money laundering.

The Assistant Comptroller General of Immigrations signed the document and copied the Nigeria Customs Service, the Inspector General of Police, the Director General of the Department of State Services, and the Director of the National Internet Agency.

Senate Warns That Looted Funds Should Not Be Used For Banks Recapitalisation

0
Deputy Speaker, Kalu Applauds Senate Over Passage Of South East Development Commission Bill, Says It'll Rebuild Damages Of Civil War

The Senate Committee on Capital Market & Institutions has cautioned against the potential risks of utilizing laundered funds for the recapitalization of banks.

The Chairman of the Committee, Senator Osita Izunazo, during the 2nd Quarter Symposium organized by the Association of Capital Market Academics of Nigeria (ACMAN), urged the Central Bank of Nigeria (CBN) to intensify efforts in ensuring that only legitimate sources of capital are used in the process.

According to him, “The recapitalisation programme comes with unique risks especially when banks opt for the private placement route. The CBN should intensify efforts to ensure that laundered funds are not used to recapitalize the banks and that only fit and proper persons end up as significant shareholders,” underscoring the importance of maintaining the integrity of the banking system.

Izunazo stressed that such risks are mitigated when banks opt for capital raising through the stock market, which provides an additional layer of scrutiny in addition to that being carried out by the CBN.

The senator expressed confidence in the resilience of the Nigerian capital market to meet the funding needs of banks undergoing recapitalization.

He stated “I am convinced that the Nigerian capital market has the depth and breadth to meet the funding needs of all the banks that will eventually approach the market for fresh capital during the two-year period of the recapitalization programme.”

Izunazo further highlighted the nexus between the money and capital markets, emphasizing the potential positive impact of a successful recapitalization program on the broader financial landscape.

On his part, the President/Chairman of Council of the Chartered Institute of Bankers of Nigeria (CIBN), Ken Opara, lauded the objective of the CBN to enhance the banking industry’s resilience and rebuild an economy grappling with high inflation and currency instability.

He added that “The Apex Bank estimates that the recapitalization process will support achieving a $1 trillion economy by 2030.”

Opara said that past recapitalization exercises had significant impacts including the increase in total bank lending and the reduction of non-performing loans (NPLs) to total loans ratio and in stabilizing financial systems during crises.

Eight Nigerians Arrested In South Africa Over Alleged Attack On Policemen

0

The South African Police Service (SAPS) have arrested eight Nigerians for allegedly attacking the operatives and damaging their vehicles during a drug raid.

The Northern Cape Provincial Commissioner, Lieutenant General Koliswa Otola, confirmed the incident that happened in the Northern Cape on Friday.

According to a South African Police Service (SAPS) statement, at the time of the arrest, police were tracing information of one of the Nigerian nationals in possession of drugs.

“While conducting this search, a large group of Nigerians attacked police. Police fired rubber bullets to disperse the crowd,” SAPS said.

One suspect was arrested for illegal drug possession and three were detained at Kimberley Police Station for public violence, South African Government News Agency said.

In addition, while the policemen were processing the case, suspects broke windows at the station. The police have since added charges of malicious damage to property.

The South African police added, “Another group of Nigerians later approached the police station and threatened to retaliate. The Operational Commander warned the group to disperse.”

Upon dispersing, the group damaged police vehicles, while another four suspects were arrested for malicious damage to property.

Otola has since condemned this behaviour and stated that those who hinder police from exercising their duties will be brutally dealt with.

“We will not allow such lawless behaviour. We are processing the suspects and working with Home Affairs to determine if they are legally or illegally in the country. Police will continue to stamp the authority of the state in the Northern Cape,” he stated.

“We will not allow such lawless behaviour. We are processing the suspects and working with Home Affairs to determine if they are legally or illegally in the country.

“Police will continue to stamp the authority of the state in the Northern Cape Province,” he added.

After Whisking Yahaya Bello Away, Lawyer Wants Gov. Ododo Impeached

0

A human rights lawyer, Deji Ajare, has urged the Speaker of the Kogi State House of Assembly, Umar Yusuf, to begin impeachment proceedings against the Kogi State Governor, Usman Ododo, over allegations of misconduct and abuse of office.

Ajare made the call in a letter addressed to the speaker, through the clerk of the House on Friday.

According to him, the use of the governor’s motorcade to ferry away the embattled former governor of the state, Yahaya Bello, amounted to the harbouring of a fugitive, obstruction of justice, and the misuse of state resources.

Governor had whisked away his predecessor at about 4:20 pm on Wednesday, after operatives of the Economic and Financial Crimes Commission besieged the latter’s Abuja residence, to arrest him in connection with an N80.2bn money laundering case.

Following his escape, the EFCC declared the ex-governor wanted while the Nigeria Immigration Service placed him on its watchlist. The Inspector General of Police also has directed the withdrawal of all Police units attached to the former Governor.

Ajare, in his letter, also called on the assembly to cooperate with the EFCC and ensure all individuals involved are available for questioning and investigations.

“In the light of the above allegations and the inherent potential breaches of statutory duties imposed by the Constitution and other relevant laws of our country, these actions, if proven true, amount to gross misconduct and warrant immediate investigation and commencement of impeachment proceedings.

“I hereby call on the Kogi State House of Assembly under your leadership to initiate a thorough inquiry into these allegations by Section 188 of the Nigerian Constitution, to ascertain the truth and to hold Governor Usman Ododo accountable if the allegations are found to be true.

“I also urge the Kogi State House of Assembly to cooperate with national law enforcement agencies, including the EFCC, to ensure all individuals involved are available for questioning and to facilitate a smooth investigation”, he said.

He further implored the House of Assembly to take swift and decisive actions, noting the effect of the “misgovernance implied in these allegations” on the people of the state.

“I thank you as I look forward to your urgent attention to this issue. I trust in your commitment to uphold the Constitution and the laws of our land for the betterment of our state and its people”, the letter also read.

However, the Chief Press Secretary to the Speaker of the House of Assembly, Mohammed Yabagi, who spoke to our correspondent via telephone, said neither the Clerk nor the Speaker had received such a letter.

Yabagi added that the House had not seen any valid reasons to begin impeachment processe against the governor and that there was no evidence that the governor prevented security agencies from arresting Yahaya Bello.

“Anybody in the public has their perception of the matter. But the House has not seen any reason, none of the members of the House were there, and none of them saw the governor trying to prevent the security agencies from doing their job. As far as the Assembly is concerned, the Assembly supports all constitutionally recognised security agencies. We have not seen any reason why the House should commence any impeachment processes.

“For context, as far as the Executive is concerned, the immediate past governor was not even at his Abuja residence, and there’s no concrete evidence that the Executive Governor prevented them from doing their constitutionally recognised job. The House is yet to receive such a letter, and the Speaker is yet to have any knowledge of such a letter,” he said.

Meanwhile, all efforts to reach the Special Adviser on Media to the Kogi State Governor, Ismaila Isah, proved abortive, as his number was switched off.

However, the Kogi State Commissioner for Information, Kingsley Fanwo, debunked reports that Ododo helped Bello, beat security operatives who wanted to arrest him.

Fanwo in an interview with Channels TV on Thursday said the governor was committed to upholding the laws of the country, including respecting its legal processes.

“Governor Ododo did not assist in Bello’s departure from his residence; the EFCC’s claims are misinformation aimed at furthering their objectives. Bello is not evading anyone; the existing court injunction protects his fundamental rights,” he said.
